Kenya Insurance company ordered to pay car theft claim within 30 days

Kenya Alliance Insurance company limited has been ordered by the Insurance appeals tribunal to settle a theft issued claim in full within 30 days.

The tribunal further ordered that it be provided with the evidence of the said settlement within seven days after completion.

The tribunal under the chairmanship of Wambua Kilonzi upheld the decision by Insurance Regulatory Authority dated 20th December 2019 which found the Kenyan Alliance Insurance company was liable to honor it’s motor vehicle Insurance policy with it insured John Mukuruma Wainaina in relation to theft of Probox KCN 896E and not accident of the said motor vehicle.

The Tribunal led by chairman Kilonzo, Martin Mithega, Thomas Koyier ,Monica Micheke and Charles Kipkulei directed that failure by the Insurance company to adhere to the order, IRA be at liberty to take action as may be appropriate under Insurance Act against them.

“Should there be failure to adhere to order, the Insurance Regulatory Authority be at liberty to take action as may be appropriate under the insurance Act against the appellant,” the tribunal ruled.

KAIC filed an appeal challenging a decision by IRA which found them liable to pay the claim of the motor vehicle they insured belonging to Maina.

Wainaina had sued the Insurance company after they failed to compensated him following the theft of his vehicle in 2018.

Being dissatisfied with the Insurance company’s decision, Wainaina filed a complaint with Insurance Regulatory Authority.
